NCEDW – What do I do each year?
These forms are services that are defined as “Noncommercial Educational Webcasters” as described in 37 CFR 380 Subpart C.
2012 RATE: $500 annual minimum fee (per station/channel), covering 159,140 aggregate tuning hours (definition at 37 CFR 380.21) monthly. Excess performances (per play, per listener; definition at 37 CFR 380.21) at $0.0020 per performance.

•NONCOMMERCIAL EDUCATIONAL WEBCASTER (CRB) MINIMUM FEE STATEMENT OF ACCOUNT FORM:(Excel)
Licensees should submit this form within 45 days of the end of the month in which any station/channel begins creating transmissions in 2012, or prior to January 31, 2012 (whichever is later). NOTE: Noncommercial services must file separate Statement of Account forms for each station/channel.
•2012 NONCOMMERCIAL EDUCATIONAL WEBCASTER (CRB) NOTICE OF ELECTION FORM (PDF)
In order to be eligible for the reporting waiver as a Noncommercial Educational Webcaster in 2011, a Licensee must have submitted a fully completed and signed copy of this Notice of Election (1) within 45 days of the end of the month in which the Licensee began making digital audio transmissions, or (2) by January 31, 2012, whichever date is later. The reporting waiver of $100 must accompany the Notice of Election.
•2012 NONCOMMERCIAL EDUCATIONAL WEBCASTER (CRB) EXCESS MONTHLY LIABILITY SOA FORM: (Excel)
These forms are due within 45 days of the end of any month in which a service exceeds the 159,140 ATH threshold. NOTE: If a service has not exceeded the threshold, there is no need to submit this form.
REPORTS OF USE: Due quarterly (if accruing excess performances, due monthly), via electronic submission (using FTP or e-mail). Standard requirements. Important exceptions listed at 37 CFR 380.23(g). Services with less than 159,140 aggregate tuning hours monthly (approximately 523 listeners listening 10 hours a day) are required to submit a total of eight weeks of data each year, in two week increments each calendar quarter, and should review the exceptions as described in the above link for more information.
Services may also waive reports of use requirements by timely submission of an annual $100 fee and Notice of Election. The threshold for waiving reporting is listenership less than 55,000 aggregate tuning hours monthly, or approximately 180 listeners listening 10 hours a day. To waive reporting, submit the Notice of Election and $100 waiver fee.
NOTICE OF USE: As a reminder, all services operating under statutory licensing must file a Notice of Use form with the Copyright Royalty Board before beginning operation (this only needs to be done once, if beginning on or after July 2004). If you have not already done so, or need to amend a previous submission, please send a check or money order for $25 along with this form to the Copyright Royalty board directly.
SO… TO REVIEW:
(1) Make sure that you have submitted the Notice of Use (plus $25, if filing new) to the Copyright Royalty Board. (This is not annual; it is only required once.)
(2) Send the reporting waiver of one annual $100 payment and the annual minimum fee of $500 (per station/channel) prior to Janaury 31, 2012 (or, if starting on or after 2/1, with your first month’s statement of account form; see (3) below…). Do not forget to sign and complete both forms (the Notice of Election and the statement of account.)
(3) If excess liability is accrued, send SoundExchange a signed and completed statement of account for the applicable month (within 45 days of the end of that month), accompanied by a payment if the form indicates one is owed. (If no payment is owed, a signed copy of the complete form may be e-mailed to royaltyadministration@soundexchange.com.)
(4) If reports of use are required to be submitted, submit them (within 45 days of the end of the applicable quarter or month) via FTP or via e-mail to reports@soundexchange.com.
